Family Child Care Home

Day Care, Home is an in-home facility providing care, protection and supervision of children or adults on a regular basis away from their primary residence. A day care, home is a limited use in residential properties zoned R-1, R-2, R-4, R-6, and R-10 (Unified Development Ordinance).

Family Child Care Home is an in-home day care operating from a residential property in which no more than five (5) children shall be cared for at any given time. A family care child home is a conditional use in residential properties zoned MH, R-15, R-20, R-30, SPR-30, AP, RB, O&I-1, O&I-2, BC, SC, NB, BUS, or TD.

Prerequisites

A family child care home must obtain approval from the City of Raleigh prior to starting operation.

  1. The family child care home must be carried out by a resident of the structure as either a sole proprietorship or a corporation that is wholly owned by residents of the structure, or a partnership where all partners are residents of the structure.
  2. The use of any accessory building or accessory structure for family child care home is prohibited. Any outdoor play equipment stored throughout the day and night shall not be permitted in the front yard area nor shall it be situated closer than fifteen (15) feet from any adjoining lot containing a dwelling.
  3. One (1) off-street parking space shall be provided for each family care home. The off-street parking space required for the family child care home shall be maintained in addition to the space or spaces required for the residence itself. No parking areas, other than driveways, may be located in the required front yard setback or in any protective yard.
  4. Only one (1) vehicle used in conjunction with the in-home family child care home shall be permitted.
  5. No person, other than members of the family residing on the premises, shall be engaged or employed. This shall not apply to a substitute non-resident person providing care on the premise while the owner/operator is sick or otherwise unable to provide such care.
  6. The structure housing the family child care home shall be similar in appearance to structures on the same block face.
  7. No more than five (5) children shall be cared for at any given time.
  8. There shall be no sign or advertisement visible from the exterior of the dwelling. The address of the property must be posted in accordance with 10-2083.1 (c) (2) of the City Code.
  9. No excessive light will be generated at the facility and all lighting shall be in accordance with 10-2089.

Expected Processing Time

Applications submitted prior to 4:00 p.m. will be processed the next business day. Applications submitted after 4:00 p.m. will be processed within two business days. If it is determined that a project does not meet the Permitting Next Day criteria, applicants will be notified that the project will be moved to an alternative permitting process.

Fees

  • Zoning permits are a minimum fee permit. Please see the Development Fee Schedule.
  • The permit fee is paid at the end of the process when the permit is picked up.
