Text Changes - FAQ


Q.  How do I initiate a proposal to amend the City Code?

A.  A proposal to amend Part 10 of the Raleigh City Code (Planning and Development) must be approved for public hearing by the City Council prior to formal review and consideration of the specific proposal by the Planning Commission and City Council.  To request consideration for amending the City Code, the proponent must contact the City Clerk’s Office at 919-996-3040 for a “Request and Petition of Citizens”.  This is a simple one-page petition requesting to be placed on the City Council agenda in order to seek public hearing authorization for the text change proposal.  A “Text Change Petition” (.doc) (.pdf) should also be completed and submitted to the City Clerk along with the “Request and Petition of Citizens”.  This form can be obtained at the office of the City Planning Department or downloaded from the City’s website at the links provided above. 

 

Q.  Is there a filing fee for proposing an amendment to the City Code?

A.  If the City Council authorizes the Text Change proposal to move forward to public hearing, a $250.00 review fee is required to be paid to the Department of City Planning.  In the event that the applicant had not previously completed the “Text Change Petition” (.doc) (.pdf), this form shall be required to be submitted along with the review fee.

 

Q.  Who is responsible for drafting the proposed amendment?

A.  The applicant is required to provide suggested language for the text change amendment when completing the “Text Change Petition”.  However, if the City Council authorizes the text change for public hearing, it is the responsibility of staff to prepare the final draft of the text change for the public hearing.  The Department of City Planning shall work with the City Attorney’s office to prepare the final draft.
